Privacy Policy

Independent Television Service, Inc. (“ITVS”) is committed to the security and privacy of your data. This Privacy Policy (“Policy”) explains our commitment to safeguarding your data and describes how we collect, use, and disclose personal information we obtain from users of our services and websites, including online features of our services (collectively, “Services”). Your use of the Services is subject to the terms of this Policy.

Information Collection and Use by ITVS

We collect information as necessary to enable us to identify you and respond to your requests for our services, to provide and improve them, and to send you information and support from time to time. When you use the Services, you may be asked to submit information such as name, email address, company name, address, phone number, and areas of interest. If you are submitting a funding application, you will be asked to provide details about your project. We may also ask you where you heard about ITVS or our services, and for other information that will help us understand more about your needs or help us process your requests for information.

We use all personal information in accordance with this Policy. Our information collection and use practices are described below:

Applications for Funding. You may be asked, as an individual or on behalf of your company, to complete an application form when using the Services. Application information may include the name of your company, your contact information, information about the project for which you are requesting funding, and other information relevant to the application. If your application is successful and you receive funding from ITVS, ITVS will retain information necessary to perform its contract with you, and information necessary to comply with our contractual obligations with third parties, and may use third party, cloud-based software to collect or transfer such information to third parties.

Registration to use Website Features. You may be asked to complete registration/activation form(s) when using the Services with contact information for use by us in accordance with this Policy. Registration or activation information may include the name of you and/or your company, an avatar you upload which may include a picture of you, your contact information, network and operating system, and other information relevant to registration.

Marketing Profile. We also collect personal information when you have or create a website profile. Profile information may include your name and contact information, the name of your company, and other relevant details regarding your interests.

Newsletters. When you subscribe or sign up to receive newsletters published or offered via the Services, we will ask you for your contact information and any other information necessary to enable us to process your request and to send you information regarding our products and services.

Cookies. We also use Cookies and functionally similar files to enhance the user experience, deliver personalized content, and advertise and collect information about the use of the Services. Cookies are small computer files that allow us to statistically monitor how many people are using the Services and for what purposes, how often someone uses the Services, and the length of their sessions. We also use Cookies to prevent you from having to re-enter your identification and password information each time you use our Services. Cookies cannot be used to retrieve personal or business data from your hard drive, your email, or any other source of personal information. Although refusal of Cookies will not interfere with your ability to interact with most of the Services, you will need to accept Cookies in order to access information and use certain functions.

Aggregate Information. We may take the information we obtain from you and, together with the personal information from other Services users, aggregate it without any identifying information, so that it is no longer personally identifiable to you or any particular user. We may combine this aggregated, anonymized data (“Aggregate Information”) with the information we receive through Cookies, log files, and other means to develop generalized information about use of the Services and other generalized information relevant to our business. Your IP address may be collected and stored for the purpose of determining unique users of the Services. We do not use IP addresses to identify or target individual users.

Information Collection. We collect additional information in connection with your use of Services or products with online features. For instance, in connection with certain of our web-based Services, we collect information such as IP address, browser, connection speed, domain, referring URL, and other environment-related information to enable us to provide a secure environment for the use of the Services, to pre-populate forms, and to calculate Aggregate Information about the customers using these Services.

Public Forums

Please remember that any information (including personal information) that you submit, post or otherwise reveal in a public forum, including in any such feature of our Services (such as a bulletin board, chat room, blog or discussion forum) will be seen by third parties not related to us. Accordingly, you should not submit any personal information to such a public forum. If you are using such a public forum on any of our Services, you are not authorized to collect or use any personal information there (including to contact any individual other than through the functionality provided by us in such public forum).

Statement Regarding Children

ITVS’s products and services are not designed to appeal to children under the age of 13. As such, the Services are not directed at children under the age of 13 nor do we knowingly collect or maintain information from children under the age of 13 through our Services.

Google Analytics Advertising Features

ITVS uses Google Analytics Advertising Features to help provide information to potential users of the Services. ITVS also uses the Google Analytics Cookie and Google Advertising Cookies to assist and drive searches from third party sites to the appropriate solution on our Services. This enables ITVS to provide and guide end users to the solution they seek more efficiently.

Google Analytics Advertising Features allows ITVS to enable features in Google Analytics that are not available through standard implementations. Advertising features we may use include: remarketing, display network impression reporting, demographics and interest reporting, and integrated services that require Google Analytics to collect data via advertising Cookies and identifiers.

You can opt-out of the Google Analytics Advertising Features that ITVS uses, through Ad Settings, Ad Settings for mobile apps, and by visiting Google Analytics’ opt- outs (https://tools.google.com/dlpage/gaoptout/) for the web or using other services such as described at http://www.networkadvertising.org/choices/. Disclosure of Your Personal Information

From time to time, we may share personal information with others: 1) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena, or court order; 2) to enforce or apply the terms of our service or license, or other agreements with you; or 3) in special cases, such as to protect the rights, property, or safety of ITVS, our customers, or others. We may also provide personal information to our vendors, suppliers, authorized resellers, funders, and other business, development, and industry entities (“Partners”) to enable them to: 1) provide us with products and services to better operate and maintain the Services; 2) assist us in processing your information; or 3) provide you with a product or service requested by you. We also may provide Aggregate Information to third parties. For example, we might inform third parties regarding the number of users of the Services and the activities they conduct while using the Services. Depending on the circumstances, we may or may not charge for this Aggregate Information. We may also use Aggregate Information as part of products or services that we provide to third parties and to improve our products and Services.

Certain Partners and government agencies may collect personal information (such as business name, address, email address, credit card information, and information about projects we select for funding) directly from you and use of that information and other information provided by you to third parties.  These actions are not governed by this Policy even though those Partners and government agencies may share such information with us.

If we participate in a merger, acquisition, reorganization, bankruptcy or similar activity, all information we have collected in or through the Services, including your information and all Aggregate Information, may be transferred to our successor or assignee if permitted by and done in accordance with applicable law.

How ITVS Protects Your Privacy Internally

We want your personal information to remain as secure as reasonably possible. We combine industry-standard administrative, physical, and technical safeguards with a code of conduct for those employees who are permitted to access our customers’ personal information. If you purchase a product or service online, we use SSL encryption to encrypt your credit card information before it is sent to us in order to protect the integrity and privacy of the information.

Many of our web-based services are hosted on servers that are co-located at a third-party facility with whom we have a contract providing for security measures. For example, information we collect through the Services is submitted via SSL encryption and stored on a third party-hosted server equipped with industry-standard firewalls.

Despite these security measures, the confidentiality and security of any information under our control cannot be guaranteed, and we do not represent or warrant that your personal information will be protected against loss, misuse, attacks, or alteration by third parties. Customers are responsible for maintaining the security and confidentiality of their usernames and passwords. If you have any reason to think your connection to our Services or any information you have submitted is no longer secure (for example, if your password has been misused) you should immediately notify us of the problem by using the email address at the end of this Policy.

Your Privacy Choices

Occasionally, ITVS may send you communications to provide you with information or promotions relating to products and services that may be of interest to you, including notification of funding application deadlines, ITVS activities in the field, and other updates about our films and activities. You may opt out of receiving these communications as indicated below.

ITVS Email Promotions. Each email promotion we send will contain instructions on how to unsubscribe in the event that you do not wish to receive future promotional emails from the ITVS unit that sent you the promotion. If you choose to opt-out of receiving promotional email communications from any ITVS unit, we may still periodically communicate with you via mail and telephone. Please allow ten (10) business days to be removed from the promotional email list of an ITVS unit.

Third-Party Email Promotions. If you access and/or use services from any of our Partners by clicking a link when using the Services, an ITVS/Partner co-branded site or by any other means, any information you reveal in connection with such service is submitted to the applicable Partner and/or third-party site and is not subject to this Policy. You should consult the privacy policy of any Partner or third-party site with respect to its treatment of any information that you may reveal in this manner.

Correcting or Updating Your Personal Information and Contacting ITVS

You can update the personal information that you have provided to us and/or change your preferences with respect to marketing communications from us by contacting the ITVS business unit to which you provided your information/preferences. Please note that it may take up to four (4) weeks to be removed from the ITVS business unit’s mail lists and ten (10) days to be removed from email and phone lists.

Linked Sites

The Services may contain links to third-party websites and resources (collectively, “Linked Sites”). These Linked Sites are provided solely as a convenience to you and not as an endorsement by us of the content on such Linked Sites. We make no representations or warranties regarding the correctness, accuracy, performance, or quality of any content, software, service, or application found at any Linked Site. We are not responsible for the availability of the Linked Sites or the content or activities of such sites. If you decide to access any Linked Site, you do so at your own risk. Your use of any Linked Site is subject to the policies, terms of use, and privacy policies of such Linked Site, if any.

Consent to Transfer, Including by European Union Residents

Users located outside the United States who submit personal information to us via the Services or otherwise provide to ITVS should be aware that the information they submit will be transferred to our servers located in the United States. The European Union has found that the US privacy protection model does not provide “adequate” privacy protections as contemplated by Article 25 of the European Union’s Data Directive (Directive 95/46/EC). Article 26 of the European Union’s Data Directive allows for transfer of personal data from the European Union to a third country if the individual has unambiguously given his or her consent to the transfer of personal information, regardless of the third country’s level of protection.

By explicitly accepting this Policy, you are consenting to the transfer of your personal information to the United States and the processing of that information as described in this Policy.

Your California Privacy Rights. 

We are providing this Policy pursuant to privacy laws in California as well as other jurisdictions. If you are a California resident, you may request certain information about third parties to which ITVS has disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response.

Changes to this Privacy Policy

This Policy was last updated June 28, 2018. We may change this Policy at any time by posting the then current Policy through the Services. We may require your review and explicit acceptance of any new terms for your continued use of the Services after such changes are posted.
